In 2020, after several years of development, the NLPA/KWA Standard 823 for sump repair was released to the industry, and shortly thereafter officially recognized by US EPA as meeting the Code of Practice requirement for allowable secondary containment sump repair defined in 40CFR§280.33 (d) in response to failure from EPA required compliance testing for sumps as identified in 40 CFR§280.35 (a).
Icon was instrumental in the Standard’s early development, as Icon President, Paul Reber, wrote the first proposals and then first draft of the document to help get the ball rolling. Icon recognized at the time that there simply wasn’t any other comprehensive formal standard that specifically addressed this area of petroleum equipment practice for regulators, UST system owners, contractors, and manufacturers that would provide sufficient direction to identify and set parameters for legitimize sump repair products and applications. It was necessary for regulators to have something official to reference when reviewing and approving approaches to sump repairs within their jurisdictions. When approved, UST system owners then benefit from the repair option allowed by EPA, and know that the products and practices are compatible and conform to specific criteria found acceptable to the regulators. It also provides the knowledge a contractor installer needs to understand when applying conforming repair products.
Ultimately, with the support of the National Leak Prevention Association (NLPA) and consultant Tony Reick, the Standard came into a formal development process. All major industry stakeholders were represented in the committee that wrote and continues to edit the Standard as it is available today. Additionally, as part of a public comment period, all of the state UST programs were invited to review, comment, and contribute before being finalized in the initial and recent revisions. Ultimately, everyone involved has felt very good about the content and process that has resulted in NLPA/KWA Standard 823.
